Alcohol Consumption in Designated Places Order

East Devon District Council intend to make an Order under section 13 (2) of the Criminal Justice and Police Act 2001 (Designated Places Order) with the aim of reducing alcohol related crime and disorder and anti-social behaviour and to reduce the fear of crime in such zones.

1. The land to be included in the Order is described in the Schedule below. The Council proposes to designate this place under the Act.

2. If the Council makes an order, then the police will have the power in the Designated Places, to:

i) prevent alcohol being drunk there; and

ii) confiscate alcohol which is not in a sealed container and dispose of it.

3. A person who fails without reasonable excuse to comply with a police requirement commits an offence and is liable on summary conviction to a fine not exceeding level 2 on the standard scale (£500).

4. The Council invite representations from the general public as to whether this Order should or should not be made no later than 28 days after the first publication of this advertisement being 9 April 2008 (no representations considered after 7 May 2008). The draft Order together with maps of the areas in Ottery St Mary to be covered by the Designated Places Order is available for inspection at :
