Revised Permitted Development Rights: On the 10th September 2008 parliament agreed changes to the planning restrictions which govern whether extensions, alterations and other works to houses require planning permission. The intention being to enable householders to carry out a greater level of works without requiring planning permission where those works will not be harmful to the amenity of neighbours or the character of the area. These changes come into effect on 1st October 2008. An interactive guide to the new legislation is provided by the Planning Portal and is available through this link. Those who have previously sought advice from the Council, whether informally or through a lawful development certificate, should note that the advice previously given may no longer apply if the works are to be carried out after the 1st October 2008. Therefore, anyone carrying out works to their property after this date, where an enquiry about the need for planning permission has previously been made, are encouraged to seek the advice of the planning department by completing and submitting a revised householder enquiry form. |

| How do I obtain confirmation of compliance with planning conditions? |
The Development Control service is currently the subject of a full review which will consider the performance of the service, as well as customer satisfaction. A number of key officers and planning officers will be engaged in this process. Despite this, the Authority is pleased to confirm that its pre-application advice service has resumed. However, priority will always be given to submitted planning applications. For all major proposals, no meeting will be entertained until the following information has been received at least 7 working days prior to a meeting:
Meetings will need to be the subject of a pre-booked appointment and, in the first instance, will be office based. However, a site visit may be entertained at a later date if it is deemed necessary. For smaller proposals, the same information as above is still required. Initially, this will be dealt with by an exchange of letters. However, if time allows, a meeting with a case officer may be possible afterwards. The Council’s priority has to be to deal with submitted applications within time limits set by the Government, and for which any necessary planning fees have been paid. However, to help you, there is a wealth of planning information available on these web-pages. In addition, there is a full list of policies guiding development in the Local Plan section of the website. The Local Plan sets out in detail every policy used by the Council in dealing with different types of applications. There are also maps showing all the development boundaries of towns and villages in the District. You may wish to take your own professional advice or submit a planning application, which is likely to be determined within 8 weeks (or 13 weeks for major applications) from its date of registration at the Council offices. The Council also operates a duty planning officer system between the hours of 9am and 12.30pm (Monday to Friday) at the Knowle Offices in Sidmouth. During this time, a planning officer will be available to answer simple enquiries and provide informal advice. East Devon District Councils' Planning Online Service provides the following facilities:
- Documents relating to planning applications available to view on-line.
- Submit comments about planning applications electronically.
- View lists of planning applications received and decisions made.
- View property details.
- View maps showing planning related information. (Note- constraints information is not available)
- Search for planning applications, properties, appeals and enforcement information.
Note- Whilst every attempt is made to ensure that records available through Planning Online are accurate the records do not constitute legally binding documentation and the Council will not be liable for any errors.
Note that the addresses used for maps produced by the Planning Online service are taken from our Local Land and Property Gazetteer. Whilst we know that the majority of properties are addressed and located correctly, there may be some errors.
