Hedgerow Regulations:
Under these regulations:
- It is against the law to remove most countryside hedgerows without permission.
- To get permission to remove a hedgerow, you must submit a hedgerow removal notice to the Council.
- If the Council decide to prohibit removal of an important hedgerow, they will let you know within 6 weeks unless you have agreed a longer time scale.
If you remove a hedgerow without permission (whether it is important or not) you may face an unlimited fine. You may also have to replace the hedgerow.
The way in which these regulations apply to individual hedgerows is complex. It is therefore advisable to discuss your proposal informally with the Planning Customer Service Officers before seeking permission. They can be contacted on 01395 571531 or by e-mail: planning@eastdevon.gov.uk
High Hedges Legislation:
New legislation relating to high hedges came into force on the 1st June 2005. Part 8 of the Anti-social Behaviour Act 2003 enables the Council to act if you complain to the Council about a neighbours high hedge.
